SIGNIFICANT CASES AND PUBLISHED DECISIONS

  • Evenson et al. v. Verizon Wireless, Case No. BC 291600, Los Angeles Superior Court joined with Logan v. Verizon Wireless Services, LLC, et al., Case No. RG 03094066, Alameda County Superior Court—I was lead co-counsel in these cases filed in April 2003. In these actions, we sought to recover commission “chargebacks” and overtime pay for a class of approximately 1000 to 2000 current and former Verizon Wireless sales employees. A settlement for $7.5 million was reached in this action in November 2006.
  • Presley v. Carter Hawley Hale Profit Sharing Plan, Case No. C-97-04316 SC, Federal Court for the Northern District of California–Counsel to class in ERISA class action to recover losses from employee stock-option plan for 20,000 former employees of Carter Hawley Hale Corporation. Litigation resulted in $36 million settlement for class. Judgment entered on January 7, 2000.
  • Voters For Responsible Retirement v. Board of Supervisors (1994) 8 Cal.4th 765 (Amicus Curiae)-Court adopted argument advocated in Amicus brief as majority opinion in case involving public employee retirement rights.
  • Claypool v. Wilson (1992) 4 Cal.App.4th 646–Represented plaintiffs in litigation concerning pension rights of California public employees.
